Why the trial of Sebastian and Atif was made bad and wrong?

I have watched the tv documentary series by Netflix yesterday night: The Confession Tapes, True East Part 1 and Part 2.

That was very good documentary. It showed how bad a judgment can be.

The episodes summery and event are like that:

The Confession Tapes, a chilling new Netflix true crime documentary series, debuted on the streaming service September 8, and the first two episodes take up the shocking case of Sebastian Burns (pictured above right) and Atif Rafay (above left), two Canadian teenagers who were accused and eventually convicted of the brutal and shocking murders of Rafay’s parents and sister in Bellevue, Washington, on July 13, 1994.

The two friends, now in their early 40s, have been serving three consecutive life terms each, with no possibility of parole, since their convictions in 2004 — a decade after the crimes. In The Confession Tapes, documentary director Kelly Loudenberg makes a compelling case that Burns and Rafay are innocent of the horrifying murders.

But if they didn’t do it, why did Burns and Rafay confess, apparently in great detail, to the crimes? Who would confess to a crime — particularly a gruesome triple murder — that he did not commit?

False confessions are the theme of the entire Confession Tapes series, with each episode documenting a case in which confessions were obtained by police using questionable and even blatantly deceptive methods — calling into doubt the guilt of the suspects who often end up convicted and sentenced on the basis of their confessions alone.

The surprising conclusion viewers may draw from the series is that false confessions are much more common than generally believed. In the case of Burns and Rafay, their confessions were elicited by undercover detectives from the Royal Canadian Mounted Police (RCMP) — Canada’s equivalent of the United States FBI — using a controversial technique known as “Mr. Big,” a method that was and remains illegal in the United States.

The undercover investigators posed as Mafia mobsters, attempting to recruit the two desperate and naive young men — whose lives had already been effectively ruined by the murder accusations — into their enterprise. But the phony mobsters told Burns and Rafay that first, they needed to know everything about their involvement in the murders.

According to Innocence Project expert Ken Klonsky, who has taken up the Burns and Rafay case, Burns — who was approached first — denied repeatedly that he was in any way involved with the savage triple murder.

“Their confessions to the RCMP mobsters took many months of heavy handed interviews to obtain,” Klonsky wrote in a blog post about the case.

“No juror was shown video evidence of Sebastian’s constant denials that he had anything to do with the crime, while the RCMP has disposed of almost the entire taped interrogation. What remains are the sessions that implicate Burns and Rafay.”

Burns finally “confessed” to the men he believed were mobsters, constructing a story from what he had absorbed from news media accounts of the killings, according to Klonsky. Rafay mainly echoed his friend’s “confessions.”

According to Klonsky, outside of the supposed confessions, “no hard or scientifically gathered evidence ties (Burns and Rafay) to the crime.” Despite the fact that Rafay’s family members were killed in extraordinarily violent fashion — the killer mercilessly bludgeoning the three to death with a baseball bat — no traces of blood or other evidence of the crime were found on either suspect despite five days of forensic testing.

“That seemed completely convincing – in a way that would only be convincing to an 18-year-old kid.”

In addition to the lack of physical evidence against them, Rafay and Burns had an apparently unshakeable alibi. They were seen and positively identified watching a movie at a Bellevue theater at 10 p.m. on the night of the murders. But neighbors specifically recalled hearing loud thumping noises from inside the Rafay home at 9:50 p.m., ruling out the presence of the two then-teens at the site as the killings were taking place, as the theater was too far from the Rafay home to be reached in 10 minutes flat — even assuming that Rafay and Burns did not stop to thoroughly cleanse themselves of any blood evidence.

But prosecutors simply called into question the neighbors’ memories of the time. In fact, the evidence against them was so inconclusive, that it took investigators in Washington six months to name Burns and Rafay as suspects in the murders.

During the gathering of the evidence and during the judgements I think there was important evidence (perhaps consciously not considered) that was missed.

In the days following the murders the Bellevue Police Department received three tips through other law enforcement agencies: one from Constable Gelinas with the Royal Canadian Mounted Police (RCMP), one from an FBI informant, and one from the Intelligence Division of the Seattle Police. The confidential RCMP informant told Constable Gelinas of a man who had been offered a $20,000 contract to kill an East Indian family that had previously lived in Vancouver, Canada and had moved to Bellevue, Washington. The informant also told Gelinas that he heard this information two days before the murders were committed. Officer Gelinas contacted Bellevue investigators Robert Thompson and Jeff Gomes—the lead investigators on the Rafay murders—and communicated the information to them. The Bellevue investigators traveled to Vancouver and knocked on this man’s door twice. He was either not home or was not answering the door. The Bellevue Police returned to the United States without making contact. About five days after the homicides, the Bellevue Police Department received a call from the FBI advising that one of their informants was coming to provide information about the murder of the Rafay family. The FBI Informant told Detective Gomes of the Bellevue Police that a militant Islamic faction said that Dr. Tariq Rafay should die because of his beliefs and teachings about the Koran. The FBI informant also said that several days after the homicides a member of this militant Islamic faction came to his house and was worried that the FBI informant had seen a baseball bat that he and some other men were carrying around in their car. Because of this, the FBI Informant believed the murder weapon was a baseball bat, which in fact it was. With this information, the Bellevue investigators learned that the FBI informant knew the identity of the murder weapon before this information was made public. The informant provided names, addresses, and phone numbers to the police. However, Bellevue investigators never followed up on these leads. The Seattle Police Intelligence Division called the Bellevue Police Department and told them they had information that al-Fuqra, a radical and militant organization, that may have been involved in these homicides. However, the Bellevue police did not follow up on this information either. They did not question any members of the Islamic community in Bellevue to find out if Dr. Rafay had conflicts with Muslims in the area.

Although various members have been suspected of assassinations and other acts of terror perpetrated in the 1980s and later,and some members having been charged with conspiracy to commit first degree murder and other crimes, ul-Fuqra itself is not listed as a terrorist group by the US or the EU. It was included in a list of terrorist organizations in Patterns of Global Terrorism, a 1999 report by the U.S. State Department.

The group has been banned in Pakistan. Jamaat Al Fuqra was also involved in the planned bombing of a Hindu temple in Toronto, Canada in 1991.

On July 29, 1983, Stephen Paul Paster, an al-Fuqra member, set off a bomb at the Hotel Rajneesh, a hotel in Portland, Oregon. This hotel, located at SW 11th Avenue and Main Street, was owned by the Rajneesh religious group and featured the Zorba the Buddha nightclub. Paster had several bombs and homemade napalm in his room, but one of the bombs went off in his hands while he was placing the bombs in the midst of the napalm.

Paster was almost immediately arrested after the bombs went off, as he was one of only two people injured in the explosion, which took place at 1:23 a.m. After the hotel was evacuated two other explosions occurred at 3 a.m. Paster was charged with arson due to the fire which resulted from the explosions.Paster posted $20,000 bail, but fled Oregon and was not apprehended until June 1984 in Englewood, Colorado. In November 1985, Paster was sentenced to 20 years in prison by a Multnomah County circuit judge,but was released after serving four years.

Pre 9/11 Massive Terror Plot Targetting 4,500 Hindus and Sikhs in Toronto Forgotten

Toronto’s (Canada’s largest city) terror plot of 1991 (pre September 11) has been forgotten and become a lost memory to Canadians.

The terror plot was planned by 5 Afro-Caribbean Muslims who were followers of Jamaat Al Fuqra, a Pakistani movement. They were acquitted of planning to kill 4,500 people within two buildings in Toronto.  The attacks were to be done one after the other. At the time of the attack, it was seen as an isolated case but now after a series of planned attacks in Ottawa, Montreal, and Toronto it has been associated with a series of attacks by Islamist terrorists. Just two years before the first World Trade Centre bombing, and a decade before the 9/11 attacks Toronto was the potential terror plot destination of North America where thousands of people would have died had the terrorists not been on the radar beforehand.

The terror plot was set to blow out during the Hindu festival of Diwali at two separate locations one after the other.  The first spot was the India Centre cinema on Gerrard Street with a 500 people capacity (most commonly occupied by Sikhs and Hindus) and the second spot was the Vishnu Hindu Temple, which has a capacity of 4000 (occupied by Hindus of mostly Indian and Caribbean descent) in Richmond Hill, Ontario.

Glenn Neville Ford, a Trinidadian convert to Islam who immigrated to Canada in the mid-1970’s is the one who started a group called the Jamaat Al Fuqra which was led by a Pakistani cleric named Sheik Mubarik Ali Gilani.

Gilani was the same man that Wall Street Journal (WSJ) reporter Daniel Pearl was supposed to meet when he was kidnapped and killed in 2002.

Ford coupled with another Torontonian from Trinidad named Max Lon Fongenie and both of them together bought a settlement land on Algonquin Park at Combermere naming it Hasanville (a small settlement for only muslim families). That same summer, the regular visitors to Hasanville where men by the name of Tyrone Cole, Robert Wesley and Caba Jose Harris—all converts to Islam, from Texas.  Police stated that together they started a plan of destruction in Toronto.

In 1991, On October 3rd, Ford and the Texans attempted to enter the US through the Niagara borders where the security at the border found a sheet of paper in their vehicle stating “dying as a soldier of Allah,” as well as floor plans and maps to the cinema and temple. One of the documents in the car even led police to Brooklyn where they found a room full of guns, weapons and 2000 rounds of ammunition.  According to police the four travellers were going to Brooklyn to pick up the ammunition.

8 men were accused. 1 was quickly dismissed. Fongenie escaped to Pakistan. A Brooklyn man pleaded guilty to weapons offences. Ford, the three Texans and another Toronto man, Khidr Ali, were sent to trial. The three Texans were kept in jail until 2006, for twelve years, after which they were freed. They were convicted for being members of a terrorist movement and for conspiring to commit mischief endangering life.

There are the news like that about Al-fuqra action at Toronto. It has always been said that Al-fuqra action was likely to be a preliminary experiment of 9/11.

Let’s turn back to the title question:

“Why the trial of Sebastian and Atif was made bad and wrong?”

If the whole process of judging of Sebastian and Atif, has been experienced as documented, then perhaps we should add a second additional question.

“If two 18-year-olds are the victims of this case, who does take benefit by protecting the real criminals?”

My opinion almost there is CIA behind of every islamic terrorist or radical militant organization on this planet. Of course, it’s not an empty belief of mine. It fulls with facts. Here an article about these facts: Jihad and Jihadists: So where do they come from?

In this case, it seems that the links of an organization, which is highly likely to be persuasive and evident, have been seriously and consciously overlooked. And the most striking feature of this organization is the possibility of making a preliminary experiment of horrific 9/11. Who was behind and staged 9/11?

If all the judgement proceedings continued in the same way as Netflix documented, then perhaps it is time to ask why the actual offenders are protected. And if the actual offenders are this organization of unexamined evidences, then is it not clear who protects them?

Or maybe all these are the conspiracy theories in my extraterrestrial mind, who knows?

ps: By the way, the judge of the case of Rafay and Burns seemeed like Hollywood actor. What kind of speech of his decision statement at the final! He seemed that he acted towards the cameras, haha!

Necessary News from Earth. A letter to my family and true friends. By Caroline P Steinbrecher.

My friends this  is just too much for me. I am still a single mother.You know I have been an advocate for the poor, disabled, abused, harmed , neglected, animals, children, ect. My entire life. Here in Colorado everyone knows what caused all this. Sorry, I have not had coffee yet.  Jake, when he was 5 would become overwhelmed at school. It is apart of SPD. He had an incredible pediatrician that was against putting kids on drugs. He made arrangements for occupational therapy. Said to me just keep doing the OT and change is diet. Well one day, Jake was frustrated, there as an event at school and they punished him by putting him in a padded closet 😦 he freaked out. Did anyone call me NO! then they let him out his flight or fight was so fired up. He was just a little guy 😦 he lashed out at a teacher.

Long story short. The DHS workers came to me and said if I did not medicate Jake they would put him in a residential treatment facility for kids with mental issues, and take him away from me. His pediatrician (who retired when Jake was 5 said NO way, he does not need drugs. I took Jake out of the Medicaid insurance and found a fantastic pediatric psychologist, and to get DHS off my back we agreed to dust Jake with Clonidine.

It was just enough to make the state leave us alone!! My friends this makes me cry. Being a mother is the MEANING of my life! I worked 4- 10 hour shifts in hospital so I could have 3 days off with my son. Later I would just pull 12 hours on the weekend so I could be there to help Jake if his SPD flared up. For the most part Jake was a snuggle bug, and just wanted to be at home with Mom.

As promised by Dr. Beasley with OT Jake grew out of the SPD 50% of the kids do!

The overdose happened at the time we had decided to start weaning Jake off the clonidine! 😦 😦

I shut down my life after the OD, I had a bit of savings and pretty much became a stay at home Mom. I just wanted to stare at my son’s face I was so happy to have him alive! I am tired my friends. I have been trying to change the US system since I was 14 years old, and they deported my grandparents. (They were my parents) I enrolled in military school. My grandparent thought my chances for opportunity would be better in the USA 😦

I never counted on people to help me, I worked hard!

 My lovely career at Colorado State University. Did not want the media attention, they put me on unpaid leave in January. They won’t even respond to my emails.

I sold my home and spent every penny over 50 grand fighting this battle!

We live in a town with no real bus system. My #one ranked law firm knew my life was falling apart and they “BRACE yourself”….TOOK a pay out to mess withy the case form the inside Leventhal and PUGA!

It was the news reporter that found out! That was a crushing blow since my main attorney was a Marine Alex Wilscke 😦  I cam barreling down on them How could they!

NO ATTORNEY WANTS THIS CASE AT ALL!

I have been told by many people in power, Caroline you do not need an attorney. You know the law, and medicine better than any attorney you can hire.

You bet the coroner swapped Jakes samples they are not his, but they will not give them to me, because they know I will DNA sample them, I have called the FBI and the CIA myself!

You bet I wanted follow up care for Jake after the OD but the umbrella insurance company ordered his new pediatrician, because my favorite retired NOT to see Jake he was a medical liability!

Search engines are filtered in the USA and it was not until I left the country that I found a case of Clonidine causing DIC! When I came back to the USA with this information, I was met with shut doors! They would not listen to me.

The day Jake died, PVH again under the same insurance company let him lay there with no pain meds or heparin! Again because orders were put in place not to treat Jake!

I have nearly lost my mind in this. There is a media black out on the story WHY I can not get one paper, one news source to run the story!

Now I sit here using my neighbor wifi, mine has been disconnected. They have done their best to break my communication. 911 even told me not to call them! The FBI said, it is a local matter BUT again. The county and the police will not respond to my calls!

Sojourner told me months ago. Stop Caroline and save yourself. I was sad. I wanted to fight to save other children. I kept on fighting. it is against every fiber in my being to watch anything suffer.

I can’t drive, I have no gas money and I have an eviction notice on my apartment. Again, everything people have known for months!

Since Lasater and Martin are not willing to negotiate the claim. I have to STOP! I have to go back to proving for my surviving children. They need me! This case has been a 24hr/7 day a week job for me with NO pay! The friends I did have ran a long time ago, it is beyond the normal comprehension of the human mind to see corruption and evil to this extent!

SO, WHY DOES EVERYONE THINK A MOM WHO LOST HER BABY AND THEN HAD THE SUYSTEM TAKE MORE THAN THAT FROM HER, CAN LIVE LIKE THIS? MY BRAIN IS RITTLED WITH NIGHT TERRORS FROM WHAT I SAW MY BABY ENDURE, AND ALL THE DOCTORS HERE WANT TO DO IS MEDICATE ME!

There is nothing wrong with me. I saw my child get tortured in front of my eyes and die. I heard my baby’s ribs break during 40 minutes of CPR. That is not something that ever leaves your mind!

Now, I can’t get ONE lawyer to help me! Not one governmental agency! This is insanity! people are so greedy they can not even donate to my Gofund me for pharmacy reform.

This fight is making me physically ill! I can not fight, if I can not even afford to go to the doctor my self!.

I don’t want to quit, but with literally NO support from anyone. I have to protect myself. How can I provide for my family, if I am too sick to even help them?

There is no sense in blogging anymore, the only people who read my blog are in other countries according to my wordpress stats!.

It is called self preservation. Lasater and Martin know that their first offer to settle was highly illegal, but they are playing games. Saying , I need an attorney. No I don’t, it is a legal right to represent yourself!

So blogging about it has gotten me nothing but support from a few fellow bloggers, who I know are just as damaged and poor as me!

I DO read my fellow bloggers websites….well the ones that I know are run by real people and not under aliases.

Women’s march

Hulya Sen; she was working as a family doctor in Istanbul before April 16, presidental referendum of Turkey, but after April 16, she resigned from her office and began a march to Ankara, the capital city of Turkey for the annulment of the referendum.

-April 17 is the start day of Dr. Hulya Sen march; in Kadıkoy square while she is greeting the other “No” activists when they are sitting.-

Dr. Hulya Sen has said about the start of the march from Istanbul to Ankara:

“The results of the referendum were announced at same night in April 16, I was in Kadıkoy square. There were tens of thousands of people at there, and none of them was seemed in a state to go back homes already. There was a rejection, there was nonacceptance; because, the referendum was shady, there were the ballots without an authenticating stamp to count. People walked rightward to leftward in Kadıkoy. They entered the streets, then they went out. The rain started and everyone went home. We woke to a day with “yes”. I did not have anything to go and study. I also do not believe that the state is the same state which I started to work 25 years ago. ‘I need to separate my road,’ said to myself. I resigned and decided to go for a march. It was kind of desperation. Because, this is a situation which neither the people can seat nor can sleep; also can not work. Walking was helping for me, that was what came to mind. I’ve started a person, but I am no longer single person. I know we’re a huge crowd.”

The result of referendum that Dr. Hulya Sen mentioned, has been announced as “the yes vote is about 51.4% and, 48.6% for the no vote” for a new presidental sytem of Turkey.

According to the result of the referendum, the map of Turkey has been shaped as follows.

Hayır means “no” ; Evet means “yes” in Turkish

The area’s size which belongs to higher “yes” votes, so colourised with white color seems bigger than the area’s size which belongs to higher “no” votes, so colorised with orange color. However, the population of “No” votes area is higher than the “Yes” votes area in Turkey. Especially at the west cities, more than half of population of including Istanbul, Izmir, also Ankara the capital, and total 17 metropol cities’ population gave “no” vote against the new presidental system of Turkey. (In Turkey there are 30 metropol cities)

Of course, the cities with more “No” votes are the cities of higher populations and the cities with more “yes” votes are the lower population cities, do not indicate that “no” will be the dominant result. It can be said that the situation can be balanced between the lower population cities where “yes” votes reaches to 70% or 80% and two major populations of Turkey such as Istanbul and Ankara where the 51% “no” votes outcome. For example, in Istanbul about 11 million voters number is equal with almost 15 middle cities’ voters number in Anatolia. If these 15 middle cities gave the “yes” votes in high percent, so let’s say average is about 75%, this can be balanced the Istanbul 51% “no” votes. But it is still very difficult question to answer: How can be possible this result, while about 49 million people live in these 17 metropol plus 16 other cities where the “no” votes are higher? Turkey population according to last datas, is about 80 million. In this regard at the population of the cities where the “yes” votes are higher, is about 31 million people.

Before Dr. Hulya Sen started to her march, the question mark about the ballots without an authenticating stamp to count, has been confusing for many people, as she stated.

The day 16 of April, at referendum day,

Before the referandum, High Electoral Board of Turkey, YSK, had been announced also made a video about how referendum will be made for the voters and the parties’ officials who will work on the ballot boxes. According to rules of referendum the ballots and the envelopes which ballots will put in, had to be officially stamped. However, while voting was underway, even half an hour before the end of voting in western cities and half an hour after voting in eastern cities is over -(in Turkey west cities’ voting process is finishing in 5 pm, east cities in 4 pm)- High Electoral Board of Turkey announced the ballots’ envelopes that had not been officially stamped, will be accepted.

“Both the opposition and the OSCE focused on a decision taken on Sunday by the High Electoral Board…he OSCE said the decision broke Turksh election law. The board “issued instructions late in the day that significantly changed the ballot validity criteria, undermining an important safeguard and contradicting the law,” the OSCE said…Opposition parties said that 1.5 million unstamped ballots had been illegally counted – enough to swing an election that had been decided by about 1.38 million votes, according to state news agency figures.” -quotes from the news of telegraph.co.uk

Another woman, Meral Aksener who seperated her political road from Turkish Nationalist Party MHP, like the other opponents was trying to reach to tv channels for hearing her voice, she was saying that, “Don’t leave the ballot boxes, there is huge manipulation from state news agency figures which were broadcasted on tv channels right now.”

Same night the people were on the streets in many city of Turkey, the women at the forefront, the people made the protest agaist the result of referandum and High Electoral Board of Turkey, YSK.

April 17-18, after referendum, Dr. Hulya Sen was on the roads towards to Ankara. She was making the statement to the local newspaper and she was saying that:

“High Electoral Board, YSK did not accept any objections, but we were expecting a different decision, you are seeing that the people gathering and saying they do not accept it. They want to walk with me, but I do not think it’s possible to walk together in the conditions of the OHAL (acronym of the state of emergency in Turkish). In fact, I think that it is not possible to propose a constitution under the conditions of OHAL. We are confronted with the imposition of a constitution without the internalization of the material, unless OHAL is removed and people have not discussed the constitutional amendment. Moreover, the election results are questionable.”

This has been subject to the OSCE report of referendum of Turkey:

“A failed coup attempt on 15 July 2016 left at least 241 people dead and 2,194 injured. In response to the attempted coup, as well as a wave of terror attacks that shook the country in 2016, the government declared a state of emergency on 21 July and extended it twice since, most recently for another 90 days starting on 19 January. Mass arrests and the prosecution under emergency decrees of over100,000 and continued detention of over 40,000 individuals, as well as dismissals of over 150,000 civil servants, followed. The state of emergency that restricted fundamental freedoms, as well as the ongoing security operations in the southeast that resulted in several hundred thousand people fleeing their homes, led to questions as to whether conditions were in place to permit a democratic referendum. In its opinion on the amendments to the Constitution, the Venice Commission noted that “the current state of emergency does not provide for the due democratic setting for a constitutional referendum.”

OSCE is continuing it’s report about campaigning of the parties:

“The campaign was characterized by the lack of a level playing field. The significantly more visible ‘Yes’ campaign, led by the governing AKP and to some extent the MHP, was supported by several leading national officials and many lower level public officials, including the prime minister and thepresident, who under the constitution is required to remain non-partisan and perform his duties without bias. These instances blurred the line between party and state… Supporters of the ‘No’ campaign faced a number of undue limitations on their freedom to campaign. Many ‘No’ campaigners suffered physical attacks. A high number were arrested, most often on charges of organizing unlawful public events or insulting the president. Some ‘No’ campaigners faced difficulties renting premises for events or had their events cancelled by the authorities or venue proprietors, often on short notice.”

Already another woman, Zeynep Altinok, who is Izmir deputy of main opponent party CHP had announced the balance of aggressive attitude over “No” supporters before the referendum.

According to Zeynep Altinok’s study, before referendum into two months, 213 people who were “no” campaigners and supporters were taken into custody; except the many knife attacks and injuries were made by “yes” supporters.

“Prime Minister Binali Yildirim, accused the people who say “No” to support terrorism…

It was also forbidden to distribute brochure to the “No” supporters in the Istanbul subway, but at the same time the electricity of the stand of the “yes” supporters, was given by the subway…

The police could not tolerate the ‘No’ written on snow by Artvin-Cerattepe people. Police erased the “NO” writing on snow by intervening…”

The physical injuries that Zeynep Altinok mentioned in her study, continued on the day of the referendum according to the news;

“..when the objection to a ‘Yes’ vote was made with the reason it’s void by Melisa Yetin in Istanbul, it come to light that that both her and another woman offical Fatma Yilmaz was attacked and wounded. It has been suggested that the aggressor group was a member of AKP Kartal Esenlik Youth Branches….After they come out of hospital, they stated that “We were in charge for the Republic. The republic gave the freedom to women. If next sunday would be the election again, we are ready to work over…”

An another woman who is CHP deputy, after the referendum day, was struggling with that,

CHP Manisa deputy Tur Yildiz Bicer asked about ‘the unstamped votes’ decision of YSK. She explained that she wanted a decision on the acceptance of the unstamped votes from YSK but she could not get a response. Tur Yildiz Bicer shared this message in a statement made on Twitter: “Today I applied to the YSK and asked the decision and circular letter about the acceptance of the unstamped votes; there is no decision, no circular letter and no answer!”

While these happened, an another woman, Burcu Celik who is HDP deputy was taken into custody.

According to news, Burcu Celik was arrested after she uncovered the doubts of the referendum results of Mus city, has also attracted attention.

And Dr. Hulya Sen has been walking, and the 4th day of her march, she gave this statement on another city’s local newspaper.

 “I feel myself as millions on this road which I started alone. I’m not tired. This action is an objection, a rebellion. The public and I are calling the High Electoral Board, YSK members to resign. Because no law can be imposed by compulsion despite public. The laws and the constitutions are made by society. You also need to draw the boundaries of the people you authorized, so that you can be called a legal text. If it gives you unlimited authority, this is not a legal text anyway. So this is not a constitution. This is a project to enforce the legal framework of unconstitutional governance. The Turkish people are not the nation to accept to such a compulsion. I have not been able to find out who wrote this draft constitution already. We know that we can find the official records of who wrote all the constitutions written up to now, including the Rescript of Gulhane.(1839)”

She is welcomed by many people at different cities when she arrives

She countinued to her statement in another city,

“Now, even either YSK says “yes” or “no”, it has no judgement anymore. After that the decision of that authority, I think there is no judgement. I think YSK is invalid. In a place where the president doesn’t acknowledge the constitution, I do not acknowledge YSK.”

Thousands of people, like herself, were in the streets to signify that they did not accept YSK’s decision. YSK has not accepted to any objection for the referendum result, and many reputable legal experts of Turkey, indicated that YSK has to accept to objections. And according to them, YSK made a silent coup against the constitutional system.

The days and nights of last week, YSK is taking own share from the people’s refusal. Women are still on the front. For example, that old woman joined the daytime protests in front of the YSK, and says the following against YSK.

“They’re shamless. They are not embarrassed. Would that be so? I can not find anything to say. God da*n you, da*n you! You are reptiles, thieves, who get illegally. We want our votes, we do not want anything else! You can have the money that you have stolen, but you give us our votes! God da*n you! They’re relentless! They could not finish the country by eating! Fill your eyes with soil!

While Dr. Hulya Sen is on her march, the women of Anatolia are everywhere on the streets and they are resisting. They are writing an another page of history of Turkey. And it seems that the new page is on the begining yet. The women have been already expressing this on the streets with the slogan “this is just the beginning” with huge crowd last one week. There are still so many road they will take, also they are aware of it. They don’t seem to leave this road. Also as far as I know the women of Anatolia, they don’t withdraw under any conditions. Those who do not take the women reactions into account will certainly be doomed to absolute failure. On the other side, the women of Anatolia know better than anyone, Ataturk and his revolution has given the best rights for women, before many other countries in the world. Dr. Hulya Sen also stated she will finish her march tomorrow, April 23 National Sovereignty and Children’s Day, at Anitkabir, the mausoleum of Mustafa Kemal Ataturk.

CIA “Accidentally” Deleted and Destroyed Its Only Copy of Senate Torture Investigation — The True News

As the government continues to suppress the entire 6,700-page Senate Torture Report, the CIA inspector general’s office recently admitted to “mistakenly” destroying their only copy of the classified report. Although CIA Director John Brennan possesses another copy of the torture report, he refuses to send a replacement to the internal watchdog’s office.

Last summer, the Senate Intelligence Committee and the Justice Department were privately informed that CIA employees at the inspector general’s office had both destroyed the disk and deleted the file containing the full Senate Torture Report. Despite the fact that the Justice Department ordered all copies of the classified document to be preserved, acting CIA Inspector General Christopher Sharpley was unable to locate another copy and eventually informed the Senate Intelligence Committee that his officers has mistakenly ruined their only copies.

On November 9, 2005, CIA Director of National Clandestine Service Jose Rodriguez Jr. authorized the burning of 92 videotapes depicting the harsh interrogations of Abu Zubaydah and ’Abd al-Rahim al-Nashiri. In response to the destruction of those tapes, the Senate Select Committee on Intelligence voted to review the CIA’s Rendition, Detention and Interrogation program on March 5, 2009. With access to over six million pages of CIA documents, the Committee merely provided a superficial summary without bothering to interview any participants or victims of the RDI program.

After CIA employees were caught hacking into computers belonging to members of the Senate Intelligence Committee, CIA Director Brennan falsely accused the oversight committee of stealing classified files. Refusing to publicly apologize for his false accusations, Brennan later privately apologized to then-Chairperson of the Senate Intelligence Committee, Sen. Dianne Feinstein.

Although then-CIA Inspector General David Buckley found his Agency guilty of hacking into the Senate Intelligence Committee’s computers, a CIA accountability panel later overturned his findings. Since the CIA announced Buckley’s resignation early last year, his deputy CIA inspector general, Sharpley, has been serving as acting IG until the president finally appoints and the Senate confirms a new replacement.

“It’s breathtaking that this could have happened, especially in the inspector general’s office — they’re the ones that are supposed to be providing accountability within the agency itself,” CUNY School of Law Prof. Douglas Cox told Yahoo News. “It makes you wonder what was going on over there?”

Instead of releasing the entire 6,700-page Senate Torture Report, Sen. Feinstein disclosed a roughly 500-page executive summary chronicling the CIA’s kidnapping, torture, and blatant deception towards Congress and the American public. While referencing multiple human rights abuses, including waterboarding, forced rectal rehydration, and the murder of Gul Rahman, the summary neglected to mention the deaths of Abdul Wali and Manadel al-Jamadi under separate CIA interrogations or the rendition and torture of an Egyptian cleric named Hassan Mustafa Osama Nasr.

Immediately after replacing Feinstein as the new Senate Intelligence Committee Chairman, Sen. Richard Burr sent a letter to the White House and several other federal agencies in January 2015 demanding they return every copy of the Senate’s full 6,700-page torture report. While ignoring the Burr’s ultimatum to return the classified document, no federal employee appears to have the courage to share the historical document with the American people.

Ordered to preserve the document while not reading it, the CIA inspector general’s office instead uploaded the file onto its internal classified computer system before destroying the disk and “mistakenly” deleting their only copy of the file. On Friday, Feinstein wrote a letter asking CIA Director Brennan to give the inspector general’s office a new copy of the Senate Torture Report.

“Your prompt response will allay my concern that this was more than an ‘accident,’” Feinstein wrote. “The CIA IG should have a copy of the full Study because the report includes extensive information directly related to the IG’s ongoing oversight of the CIA.”

While declining to comment on Feinstein’s letter, Dean Boyd, the CIA’s chief of public affairs, recently told Yahoo News, “I can assure you that the CIA has retained a copy.”

Given the Agency’s history of deception and Brennan’s refusal to provide the inspector general’s office with another copy, the CIA once again appears to be operating without any oversight or accountability. Although the IG is responsible for independent oversight of the CIA, the IG actually reports to the Director of the CIA, according to the Agency’s website.

With the exception of former CIA contractor David Passaro, who beat a detainee to death with a metal flashlight, no CIA officer has yet been charged with committing torture, murder, or destruction of evidence. No charges are expected from the so-called Justice Department.

Exactly two years ago today, it has experienced the biggest occupational homicides at the history of Republic of Turkey. Two years have passed over the day which the 301 miners’ breath wasn’t enough to reach the exit door of the coal mine at Soma.

There isn’t any meaning the question of “Is there anything changed after the massacre?” Because, Soma massacre occurred again and again every day during two years.

Only just a few months passed over it. Without becoming cool of the burning coal at Eynez mine at Soma where 301 miners lifeless body left behind, 10 workers lost their lives inside the elevator that crashed down from the thirty-second floor of the giant construction area which is built by Torunlar(building company) at Mecidiyekoy, Istanbul.

The common point of the two businesses of the bosses is that they have taken the high privileged government jobs at the period of the AKP. In fact, the second one was a school friend with Erdogan from imam hatip high school(kind of religion schools at Turkey). But the original partnership was safe box.

After then, the massacre continued at Ermenek. This time, the boss of the coal mine was not a friend from high school, but he was an utter pro-AKP, a money-hungry coal merchant. Already almost all the coal mines in Ermenek, was ran by his family. 18 miners have died with the explosion of the water which filled in the old gallery with coming from the active part of mine quarry. Hundreds of meters under the ground, they died by drowning. It was found slime and water in their lungs at autopsy, not carbon monoxide.

After Ermenek, massacre continued at Sırnak. This time, mine quarry was illegal. For a time, they couldn’t make identified who died. After Kozlu. And then the others…

Soma massacre continued at the coal mines, construction areas, factories, truck haulages during two years.

It wasn’t enough. Massacre continued at the Assembly tables. After Soma, the government changed dozens of laws which weren’t relative with each other by putting forward to improve the working conditions of the miners. With all that, as soon as laws pass the parliament, in this time thousands of miners found themselves at the door of mines(fired from job). Such arrangements, two minimum wages, 6 hours working per day, plus 4 days annual leave have been appetizer of mine bosses who stopped the producing at mine quarries. Bosses took what they want into three days, and on the other hand the “spring cleaning” was also completed. When the mine quarries began production again, all the miners who were fired from job were not able to take back to their job. So once again the massacre returned back to the coal mines in Zonguldak, Kütahya, Ermenek, Nevsehir and etc from Assembly’s halls at Ankara.

Massacre sometimes has been the slap of Prime Minister on the face of a miner who sought refuge in the store while he was trying to run from the police violance during protest; sometimes it has been the undersecratary’s kick at the back of a miner who felt anger and pain at the same time while he was falling down the ground. And sometimes, the massacre has been the becoming unemployed of more than two thousand miners without taking “a single penny”; sometimes it has been the law cases which opened against the miners who protested “the statesmen”, and their testimonies at these cases.

The massacres at Soma continued during two years.

Actually, the massacres hadn’t started with Soma. While Erdogan was thanking to the Ministers of Labour who have worked at AKP’s period(into last 14 years of AKP governments 4 Minister of Labour worked) from the reading desk at the first day of “International Occupational Health and Safety Conference” which held eighth in this year, the number of workers who lost own life in occupational homicides has reached 15,000 people during his ruler. AKP has been the power which caused to infected most blood of workers to the hands of capitalism.

We are in the day of “anniversary of Soma massacre”. And the massacre is still continuing.

The lawsuit against the refugees’ deal: It was sued to EU Court of Justice

The consensus which was made between Turkey and EU to get under the control of immigrants which the majority is composed of Syrian refugees, went on trial. AYVA foundation which has established in Izmir city of Turkey and STOP ngo, within the scope of the understanding of stopping migration at EU borders and locking inside Turkey, and on demand the determination of measures including administrative and the lack of political solutions, has litigated.

The representatives of AYVA and STOP have made a call to EU commission and European Council about the refugee problem in the meeting hall of Izmir Bar Association with a press conference.

One of the AYVA representatives journalist Feyzi Hepsenkal said in his explaining:
“Refugee issue is a matter of human rights first and foremost. You cannot solve Syrian refugees issue by locking them inside Turkey. Your thoughts that you inflict the problems related with social and security created by refugees on Turkey, are showing that you didn’t understand the issue and you’re in big wrong. You cannot stop the refugees’ flow with this way. You made the connection between the problem of Syrian refugees and visa liberalization for Turkey citizens and EU accession process of Republic of Turkey; this is problematic in terms of ethic. You should see this frame that you wanted to create over human life, damages to positive perception of EU values which occured in many years.”

Hepsenkal said that the refugees die with fluttering as well as the latest example in Ayvalik and Dikili(*), the humanity is drowned openly and it is seen that EU is accepting the understanding of irregular migration is stopped at EU borders and locking inside Turkey. He continued to his explanation:
“We are warning:
Exhibited approach is contrary to,
– The relating to Status of Refugees (Geneva) contract, 28 July 1951
– The protocol relating to Status of Refugess, 1967
– The principle of “refoulement” which has been accepted by UN High Commissioner of Refugees as a mandatory rule of international law
– Universal Declaration of Human Rights, article 14 paragraph 1, 10 December 1948
– European Convention relating to Protection of Human Rights and Fundamental Freedoms, 4 November 1950, Rome

With this reason, we make an application to Presidency of Court of Justice EU by examining the inadequate solution which was found by political leaders and with the thought of creating jurisprudence decisions. In the process that we started, we call everyone for solidarity.”

The representative, lawyer Senih Ozay said that Europe entered into shock because of refugees. Ozay said: “EU said let give 3 billion Euros to Turkey. They say that they would provide the visa facilitation and the refugees stay in Turkey. EU agreed with Prime Minister of Turkey, Davutoglu. We also prepared our application to international court. We’re hopeful. Maybe with this sued, it would be taken an important decision for solving the issue of refugees.”

Besides if you want to see what happen at Aegean Sea, you just write “Aegean Sea and refugees” or in Turkish “Ege’de multeciler” at google. You can see how the horror continues boths side of Aegean Sea, so at coast of Turkey and Greece despite cold and rough sea. This tragedy was never decline, it continues to increase day by day.

As you can see, any deal between the politicians cannot work for refugees problem. I hope with this sued EU Court of Justice would make realistic and constructive decision for humanity.

Emails in the searchable database disclose the company’s negotiations with intelligence and police agencies to supply some of the advanced technology used to secretly hack into, take control over and monitor computers and smart phones.

In its emails, Hacking Team boasts that its programs can “attack, infect and monitor target PCs and smart phones, in a stealth way” and “bypass encryption, collect relevant data out of any device, and keep monitoring your targets wherever they are, even outside your monitoring domain.”

“Do I take off my boots? Stretcher would not become dirty with my boot’s slush.”

The words of the title were told after coal mine disaster a year ago, 13 May 2014 Soma, Manisa, Turkey. These belonged to miner Murat Yalcin, who survived from tragedy that 301 coal miners died tragically:
“Do I take off my boots?”
Later an interview, Yalcın was asked that why he said this. His answer was very significant.
“After me, my friends will have to be removed from the mine. And I do not want to be moved of them with a dirty stretcher. ”

Unfortunately, it has not been as he wishes. 485 workers were rescued, 301 workers and 1 mining engineer lost their life.

What happened after this incident was a tragedy. The families of the 301 miners who haven’t proper safety and healthy working conditions, could not get months salaries. Currently, the monthly salary which was given by AKP government to these families is 100 euros AKP government did not keep the promises. It has put a ban on the press and obstructed those who bring this issue to the agenda with all kinds of obstacles. Even, one of advisers of Recep Tayyip Erdogan who is president of republic today, kicked to a young man who was protest to Erdogan. That day at Soma, Recep Tayyip Erdogan had encountered an anger.

Then the words which R.T. Erdogan said that reveals how is desperate the situation in Turkey for workers:
“This way of death, is into the fate of this work.”

The answer to him was given by Soma mine worker, Engin Dagli:

“I wasn’t there when prime minister came. Also, I moved away when I heard that he came. I do not want to see even his face. However, he said
“This way of death, there is into the fate of this work.”. I want to ask him: Is it fate, if a man jumps out from the top of a ten-story building? Top it all off, R.T. Erdogan is giving an examples from mine accidents from France or China.

And another question:
Soma Construction Company which is the original owner of the mine, is especially protected. What is the reason?
Dagli: There is only one reason. Melike Dogru, who is wife of administrative manager of the mine and also the general manager, in the March 30 elections, she was nominated a member of the AKP provincial council. At the same time the company is the company that AKP distributes coal. (AKP government, before every election, distributes coal to poor people and collects votes).

To cultivate business in mine, over-production was done; lest stop production, shift changes were made gradually and there was no job security. Even, the owner of the mine had said unashamedly:
“We produce at tons of coal 23.8 dollars, while Turkey Coal Enterprises produces at tons of coal 130-140 dollars.”

So workers were running excessive. Shift system functioned unhealthy. There was no job security. And all the money they were receiving a monthly salary of 450 euros to 750 euros.

The security video recordings about what happened on that day, emerged in April 2015.

From the beginning first minutes of the video, there is the security cameras images of the day. From the second minute, and now disaster had been; the other miners and even their wives began to come to mine, to get news or to recover. While workers go out on the one hand, rescuers enter to inside on the other hand. In 3 minutes a worker gives an effort to explain of the status to outsiders. From 4th minutes the bodies of the miners begin to take out. From 5:20 minutes the anger and the rebellion of the miners is seen.

After 8 months after the disaster, the Republic of Turkey prosecutors could not prepare for a indictment about Alp Gurkan who is mine owner. And this man was not arrested until today. Already, according to mine owner, the responsibility of disaster belongs to mining engineer, who died in mine or those who make conspiracy. Thereupon, the relatives of the miners, collectively, they sued for damage and now it is heard in those days. It is still continuing.

For this case, which turned into a scandal, the workers’ relatives are experiencing the same pain almost every month in courtrooms.

The cries of the workers’ relatives outgrow the court hall. Here is, some of their words:

“I rather than the death of my husband, I’m sorry the poverty that he lived.”
“My husband never had a new shoe. Because, he always wore boots.”
“Our children always use black color in the paintings that they make at school.”
“After my husband died, the state gave 100 euros monthly salary. Is this my husband’s value?”

You can say poverty or despair for all happening. But it is the same name in all the world’s languages: Wild capitalism. The oppression of the working class has not been a realistic pain as today’s. The workers have no name in the new world order. Workers are used as slave.
